Recently, I discussed a situation where a Tenant filed for Bankruptcy protection. However, the Lease was guaranteed by 2 individuals. The individuals did not have an agreement between them in the event the guaranty was called upon. In addition, the Tenant had a counter-claim to the Landlord's claim for payments. The Bankruptcy filing changed the entire picture.
